Introduction

In order to provide our services through our app, services, features, software, or website (“Vibin Platform”), we need to obtain your agreement to our Terms of Use ("Terms"). Vibin Fam LLP ("our," "we," "us" or “Company”) provides the services as available on Vibin Platform. These Terms govern your access to and use of our services including our various websites, SMS, emails, notifications, applications, buttons and widgets that link to these Terms (collectively, the “Services”), and any information, text, links, graphics, photos, audio, videos, or other materials or arrangements of materials uploaded, downloaded or appearing on the Services (collectively referred to as “Content”). By using the services you agree to be bound by these Terms. These Terms are to be read with our Privacy Policy. If you do not agree with the terms and conditions of these Terms, please do not use the Vibin Platform.

Who Are We

Vibin is a B2B tech platform enabling organizations and professional bodies to enable their team members to interact and connect with each other in a meaningful way. Vibin aims to build thriving communities of like-minded individuals.

Account Creation

We will need some information from you to get you set up with an account on our Vibin Platform, including your name and your contact information, like your mobile phone number and email address. The information that you provide may be subject to additional verification. You agree that you will provide us with accurate, true, and complete information about yourself whenever you are prompted to provide us with information, and that you will update such information whenever it changes. Your failure to do so may constitute a breach of these Terms. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable. You agree that you will maintain the security of all information that you provide to us, and that it is solely your responsibility to keep your username, devices used to access the Vibin Platform, and all other materials secure and confidential. We assume that any transaction initiated or activity that takes place through your account using your credentials is authorized by you. If you become aware of any unauthorized access to your account or any transaction made through your account that was not authorized by you, it is your responsibility to let us know immediately by contacting us at connect@vibinfam.com. It is important that you regularly check your account to ensure that all activity that occurs on it was authorized by you. We are not liable for any damages or losses that you incur due to unauthorized access, unless you have notified us immediately as indicated above. You may not sell or otherwise transfer your account or any portion thereof. If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Vibin Platform (or any portion thereof).

Eligibility

If you access or use our Platform, you represent and warrant that you are at least 17 years of age or at least the age of majority in your jurisdiction. Users between the age of 17 to 18, must have signed permission from your parent or legal guardian to access or use the Vibin Platform which, upon demand, you agree to submit to Vibin. You also warrant that you are legally competent and able to be bound by these Terms, and that you have not been previously banned from using the Vibin Platform for any reason. If you are unable to make these representations and warranties or don’t agree to any part of our Terms, you may not access or use our Vibin Platform.

User Generated Content

We strongly believe in the freedom of expression and allow you to share photographs, images, videos, status updates, and other content on our Platform (“Your Content”). You retain your rights to Your Content that you submit, post, or display on the Vibin Platform. What’s yours is yours and you own Your Content (your incorporated audio, photos, and videos are considered part of Your Content). We do not have any ownership over any of the content shared by you and the rights in the content remain only with you. You hereby agree that you will not use Vibin Platform to violate or infringe upon our or any third-party’s intellectual property rights. You further agree that you will not post objectionable or abusive content. Such content is against our Community Guidelines and may be removed from the Vibin Platform. Further, if you use any content developed by us, then we shall continue to own the intellectual property rights vested in such content. By sharing/posting/uploading content on the Vibin Platform, you grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, use, distribute, run, copy, publicly perform or display, translate, and create derivative works of your content (consistent with your privacy and application settings). You remain solely responsible for the content you post on our Vibin Platform. We do not endorse and are not responsible for any content shared or posted on Vibin Platform, and for any consequences resulting out of such sharing or posting. However, it is important to note that individual user activities and content remain private and are not shared with third parties without explicit consent, except as required by law.

Restricted Use

You may not either directly or through the use of any device, software, internet site, web-based service, or other means, modify, publish, transmit, stream, upload, display, participate in the transfer or sale, create derivative works, or in any way exploit the content of the Vibin Platform not owned by you or any portion of such content except as expressly provided herein. You may not use any data mining, robots, or similar data gathering and extraction tools on the content, frame any portion of the Vibin Platform or content, or reproduce, reprint, copy, store, publicly display, broadcast, stream, transmit, modify, translate, port, publish, sublicense, assign, transfer, sell, loan, or otherwise distribute the content which is not owned by you without our prior written consent.
